Booking Terms and Conditions

Information applicable to the booking and participation in the services, excursions, expeditions, and activities offered by Exploria S.A.C.

Please read these Terms and Conditions carefully before making a booking. By completing and submitting the Booking Form and making the corresponding payment, the customer declares that they have read, understood, and accepted these Terms and Conditions.

A booking will only be considered confirmed once Exploria S.A.C. has communicated its acceptance in writing and confirmed receipt of the corresponding payment.

1 Bookings and Payments

1.1. To request a booking, the customer must complete the Booking Form and make a deposit of USD 300, which will be applied toward the total price of the service.

The deposit is non-refundable when the cancellation is requested by the customer, in accordance with the conditions established in Section 2.

1.2. Prices will be quoted in U.S. dollars and, where applicable, in Peruvian soles, indicating the applicable exchange rate. The final price will include the taxes, commissions, and charges previously disclosed by Exploria S.A.C.

1.3. Any outstanding balance must be paid no later than 30 calendar days before the start of the service.

1.4. Bookings made 30 calendar days or less before the start of the service must be paid in full at the time of confirmation.

Available Payment Methods

  • Bank transfer or bank deposit.
  • Western Union.
  • Credit or debit cards.
  • Cash.
  • Digital payment platforms such as Yape or Plin.

Before payment is completed, Exploria S.A.C. will inform the customer of the final amount applicable to the selected payment method, including any processing costs previously disclosed and accepted by the customer.

2 Cancellations and Refunds

2.1. Cancellation requests must be submitted in writing to info@exploria.tours. The cancellation will be considered received once Exploria S.A.C. confirms receipt.

2.2. The following cancellation charges will apply, calculated according to the date on which Exploria S.A.C. receives the cancellation request:

  • 31 calendar days or more before the service: loss of the USD 300 deposit.
  • Between 21 and 30 calendar days before the service: cancellation charge equivalent to 50% of the total price.
  • 20 calendar days or less before the service: cancellation charge equivalent to 100% of the total price.
  • In the event of a no-show, late arrival, or withdrawal: no refund will be provided.

2.3. The deposit will be applied toward the corresponding cancellation charge and will not be added separately to that charge.

2.4. Where a refund is applicable, non-recoverable costs previously disclosed and actually paid to hotels, transport providers, operators, suppliers, or other third parties may be deducted.

3 Changes, Expeditions and Mountaineering

3.1. Any change requested by the customer, including changes to dates, destination, activity, itinerary, or additional services, will be subject to availability.

Before making any change, Exploria S.A.C. will inform the customer of any applicable fare difference, penalty, or additional cost.

3.2. When circumstances beyond the reasonable control of Exploria S.A.C. occur, including dangerous weather conditions, route closures, roadblocks, natural disasters, social unrest, or orders issued by authorities, the company may propose:

  • An alternative activity or destination with equivalent characteristics.
  • Rescheduling the service.
  • Another solution permitted under applicable law.

Any substantial changes will be communicated to the customer in a timely manner.

3.3. Exploria S.A.C. may prevent, suspend, or terminate a customer's participation when there are objective reasons related to their health, safety, conduct, consumption of alcohol or substances, failure to follow instructions, or risk to other participants.

3.4. Mountaineering and adventure tourism activities are subject to the weather, geographical, physical, and safety conditions existing during the activity.

3.5. The guide has the authority to modify, suspend, or terminate an activity when they reasonably consider that continuing would pose a risk to the customer, the guide, or other members of the group.

3.6. If an early return occurs due to the customer's decision, medical condition, failure to comply with the rules, inappropriate conduct, or safety reasons not attributable to Exploria S.A.C., services already provided and committed non-recoverable costs will not be refunded.

Important: these provisions do not limit any liability that may legally correspond to Exploria S.A.C. for breach of contract, negligence, or acts attributable to the company, its employees, guides, or contracted operators.

4 Customer Responsibilities

4.1. The customer must assess whether they have the physical and mental condition necessary to participate in the contracted activities.

4.2. Individuals with cardiovascular or respiratory conditions, hypertension, asthma, recent injuries, pregnancy, or other relevant medical conditions should consult a healthcare professional before participating.

4.3. Exploria S.A.C. may request a medical certificate when the customer's age, declared condition, altitude, difficulty, or characteristics of the route justify such a requirement.

Customers over 65 years of age must provide a medical certificate confirming their fitness to participate in the contracted activities.

4.4. Expeditions may take place in remote areas with limited access to medical services. The customer is responsible for having insurance that covers medical treatment, rescue, and evacuation, unless the package description expressly states that such coverage is included.

4.5. Participation under the influence of alcohol, drugs, or medication that may compromise the safety of the individual or the group is prohibited, unless such medication has been prescribed and previously disclosed to Exploria S.A.C.

4.6. The customer must present a valid DNI or passport and, where applicable, a visa, immigration permit, travel authorization, or any other documentation required by the authorities.

5 Medical Declaration and Personal Data

5.1. By booking and participating in the activities, the customer declares that:

  • They are in appropriate physical and mental condition to participate in the contracted activity.
  • They have truthfully disclosed any medical condition that may affect their participation.
  • They will communicate any relevant change in their health before or during the activity.
  • They have taken the necessary medical and health precautions.
  • They have the vaccinations, medications, and insurance required for the activity.

5.2. The collection, storage, use, or disclosure of medical information will be carried out in accordance with Exploria S.A.C.'s Privacy Policy and with the customer's prior, express, and informed consent.

5.3. In an emergency, Exploria S.A.C. may provide medical services with the information strictly necessary to protect the participant's life, health, or physical integrity, in accordance with applicable law.

6 Travel Insurance

Unless expressly stated in the package description, the prices of contracted services do not include medical or travel insurance.

The customer must obtain an insurance policy that covers, depending on the nature of the activity:

  • Accidents and medical treatment.
  • Rescue and evacuation.
  • Activities performed at altitude.
  • Mountaineering or adventure tourism.
  • Trip cancellation or interruption.
  • Loss, theft, or damage to luggage.

Exploria S.A.C. may request proof of insurance coverage before the expedition begins.

7 Complaints and Claims

7.1. Any issue occurring during the provision of the service should be immediately reported to the guide or representative of Exploria S.A.C. so that a timely solution may be sought.

7.2. The customer may also submit inquiries, complaints, or claims through:

7.3. Customers are encouraged to report any issue as soon as possible to facilitate its investigation and resolution. This recommendation does not limit the customer's consumer rights or their right to contact Indecopi or any other competent authority.

8 Acceptance of Risks

8.1. The customer acknowledges that adventure tourism, trekking, climbing, and mountaineering activities involve inherent risks, including:

  • High altitude and altitude sickness.
  • Sudden weather changes and extreme temperatures.
  • Rock, ice, or snow falls.
  • Uneven, unstable, or slippery terrain.
  • Fatigue and physical exertion.
  • Geographical isolation.
  • Limited access to medical assistance.
  • Risks inherent to nature and outdoor activities.

8.2. The customer accepts the inherent risks of the contracted activity, provided such risks are not the result of breach, negligence, or acts attributable to Exploria S.A.C., its employees, guides, or contracted operators.

9 Use of Photographs and Videos

9.1. Exploria S.A.C. may only use the customer's image, voice, photographs, or videos for advertising, informational, institutional, or promotional purposes when prior, express, and voluntary authorization has been provided.

9.2. Refusing to authorize the use of one's image will not affect the booking or provision of the service.

9.3. In the case of minors, authorization must be provided by their parent, guardian, or legal representative.

10 Applicable Law and Dispute Resolution

10.1. These Terms and Conditions are governed by the laws of the Republic of Peru.

10.2. The parties will endeavor to resolve any disagreement through direct communication and in good faith.

10.3. The customer may use the Complaints & Claims Book, contact Indecopi, or exercise their rights before the competent administrative or judicial authorities.

10.4. No provision of these Terms and Conditions shall be interpreted as a waiver, restriction, or limitation of the rights granted to consumers under Peruvian law.
